Ethical Use & Acceptable Content Policy

1. Purpose

DeepSwapAI is an entertainment and creative AI tool. The service is designed for legitimate creative expression — memes, personal photos, fan art, short films, marketing content where every depicted person has given consent, and similar lawful uses. This policy defines what is and is not allowed on the platform.

2. Consent Requirement

You may only upload images or videos of:

• Yourself.
• A person who has given you clear, informed permission to use their likeness in an AI face swap.
• A public-domain or rights-cleared asset where face swapping is expressly permitted by the license.

You are responsible for securing consent. By uploading, you warrant that you have the legal right to any likeness depicted.

3. Prohibited Content

Regardless of consent, the following content is strictly prohibited on DeepSwapAI:

• Non-consensual intimate imagery (NCII), including any AI-generated sexual content of a real person without their explicit consent. This is illegal under the U.S. TAKE IT DOWN Act (2025), multiple U.S. state laws, and analogous laws in the UK, EU, and Australia.
• Any sexual content involving minors, real or simulated. Zero tolerance — accounts are terminated immediately and reported to NCMEC.
• Non-consensual political deepfakes intended to deceive voters (violates U.S. federal and state election-integrity laws, EU AI Act 2026).
• Identity fraud, impersonation of public figures for deception, financial fraud, or KYC bypass.
• Defamatory content designed to falsely depict a person committing a crime or act that damages their reputation.
• Harassment, doxxing, or targeted abuse of any individual.
• Violent extremism, terrorism, or incitement to violence.

4. TAKE IT DOWN Act Compliance (U.S.)

The U.S. TAKE IT DOWN Act (effective May 2025) requires platforms that host user-generated AI content to remove reported non-consensual intimate imagery within 48 hours.

If you are a victim or see such content on our platform, file a takedown at /dmca or email [email protected]. Requests are processed within 48 hours, content is removed, and we cooperate with law enforcement where required.

5. EU AI Act (Deepfake Disclosure)

Under Article 50 of the EU AI Act (in force Aug 2026), AI-generated content depicting real people should be labeled. If you distribute DeepSwapAI output publicly in the EU, you are responsible for disclosing that it is AI-generated. We recommend including a clear label (such as "AI-generated" or "Made with DeepSwapAI") on public distribution.

6. Biometric Data Handling

Faces in uploaded media are processed as transient facial landmarks for the purpose of the requested operation only. We do not build or retain biometric templates, do not sell face data, and do not train models on user uploads. All raw uploads are deleted within 24 hours. This approach is designed to comply with Illinois BIPA, Texas CUBI, California CCPA Article 3(c), and GDPR Article 9.

7. Enforcement

Violations can result in:

• Immediate content removal.
• Account suspension or permanent ban without refund.
• Reporting to NCMEC (CSAM), IC3 (fraud), or relevant national authorities.
• Cooperation with law enforcement subpoenas and preservation orders.

All reports are triaged within 48 hours. Emergency safety reports (CSAM, imminent threat) are actioned immediately.

9. Updates to This Policy

We may update this policy as laws and platform practices evolve. Material changes will be announced on the homepage or via email to registered users at least 14 days before taking effect.
