Terms of Service

These Terms of Service ("Terms") govern your use of DeepSwapAI, the browser-based AI face swap service at https://deepswapai.com. By creating an account or using the service, you agree to these Terms and to our Privacy Policy, which explains how we handle your data. If you do not agree, do not use the service.

1. The service

DeepSwapAI lets you create AI face swaps in your browser — for single photos, multi-photo batches, videos and GIFs. You upload source media and a face reference, and the service generates the requested output. Generation tasks are processed with the help of third-party AI inference providers; your uploads are sent to them only to produce your requested result and are never used to train AI models (see the Privacy Policy for details).

2. Eligibility

You must be at least 18 years old to use DeepSwapAI. By using the service you confirm that you are 18 or older and legally able to accept these Terms. We may suspend or terminate accounts that we reasonably believe belong to anyone under 18.

3. Your account

• You can sign up with an email address and password, or with Google sign-in. Sessions are maintained with a session cookie.
• You are responsible for keeping your credentials secure and for all activity on your account.
• Provide accurate information and keep it up to date.
• You can delete your account at any time from your account settings, or request deletion through the in-app support ticket system ("My Tickets").

4. Credits and payments

How credits work

• The service runs on prepaid credits. Each generation task consumes credits.
• We may grant some free credits at our discretion.
• If a generation task fails, the credits it consumed are automatically refunded to your account.
• Credits are for use within the service; they are not cash and have no monetary value outside DeepSwapAI.

Payments

• Purchases are processed by the third-party processor and payment method displayed during checkout. Available methods may include card, Alipay and WeChat Pay.
• DeepSwapAI does not store full card numbers.
• Your payment may also be subject to the terms of the payment processor you choose.

5. Consent and content rules

This is the most important section. Face swap technology must be used responsibly.

Consent requirement

You must have the consent of every real person depicted in the media you upload and in the outputs you create. Do not upload someone's photo or video, or use their face as a reference, without their permission.

Prohibited content and uses

You must not use DeepSwapAI to create, upload or distribute:

• Any content involving minors — under any circumstances.
• Sexually explicit deepfakes of any person.
• Content used for harassment, intimidation or bullying.
• Defamatory content, or content presenting fabricated events as real to damage someone.
• Content used for fraud, scams or deception.
• Impersonation of any person for deceptive purposes.
• Any other unlawful use under the laws that apply to you.

Violating these rules may lead to immediate suspension or termination of your account, removal of content, forfeiture of remaining credits, and — where required — reporting to relevant authorities.

6. Your content and our rights

• You keep whatever rights you hold in the media you upload and, to the extent permitted by law, in the outputs generated for you.
• You grant DeepSwapAI the limited rights needed to operate the service: to store your uploads and outputs temporarily, transmit uploads to AI inference providers to fulfill your generation requests, and display your results back to you. DeepSwapAI media files are automatically removed within 24 hours.
• You are solely responsible for your uploads, your outputs, and how you use them. Make sure your use of any generated content is lawful where you are.

7. Our intellectual property

The DeepSwapAI service — including the website, interface, branding and underlying technology — belongs to DeepSwapAI or its licensors. These Terms do not grant you any rights to it except the limited right to use the service as intended.

8. Third-party services

The service relies on third-party AI inference providers for generation and third-party payment processors for purchases. We are not responsible for the acts or omissions of third-party services you interact with directly, such as your chosen payment method.

9. Availability and changes to the service

We work to keep DeepSwapAI available, but the service is provided without a guarantee of uninterrupted operation. We may change, suspend or discontinue features. If a generation task fails for any reason, your credits for that task are automatically returned.

10. Termination

• By you: delete your account at any time in account settings, or via a support ticket.
• By us: we may suspend or terminate your account if you breach these Terms — especially the consent and content rules in Section 5 — or if required to protect users, third parties or the service.
• On termination for breach, remaining credits may be forfeited.

11. Disclaimers and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by applicable law, including warranties of merchantability, fitness for a particular purpose and non-infringement. AI-generated results vary and may not meet your expectations.

To the fullest extent permitted by applicable law, DeepSwapAI will not be liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify DeepSwapAI against claims arising from your content or your breach of these Terms, including any claim by a person depicted in media you uploaded without their consent.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version; we encourage you to review these Terms periodically. Continuing to use DeepSwapAI after an update means you accept the revised Terms.
