Welcome to FaceSwapAI ("we," "our," or "us"). By accessing or using our website, API, and AI-powered services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully. If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and FaceSwapAI.

2. User Eligibility

By using the Service, you represent and warrant that:

• You are at least 18 years old. The Service is not intended for individuals under 18. • You have the legal capacity to enter into a binding contract. • You are not located in a country under U.S. embargo or subject to applicable sanctions.

3. Acceptable Use Policy (Strictly Enforced)

FaceSwapAI uses advanced generative AI. We prioritize safety and ethical use. You agree NOT to use the Service to create or distribute:

• Non-Consensual Sexual Content (NCII), including nude or sexual deepfakes of real individuals without explicit consent. • Child Sexual Abuse Material (CSAM) — any depiction of minors in sexual or suggestive scenarios. Violations will be reported to authorities. • Harassment, Bullying, or Defamation. • Misinformation or Fraud, including political deepfakes, identity theft, or fake news. • Illegal content or activities under any applicable law.

Violation of this policy will result in an immediate and permanent ban, including IP blocking.

4. Intellectual Property & Content Ownership

4.1. Your Content You retain ownership of the photos and videos you upload ("User Content"). You grant FaceSwapAI a temporary, non-exclusive license to process your content solely for generating results.

We do not use your content to train AI models.

Uploaded files and generated results are automatically deleted after a short retention period (e.g., 1–24 hours).

4.2. Generated Content Subject to compliance with these Terms, you own the rights to the AI-generated results you create and may use them for personal or commercial purposes, provided they do not violate Section 3.

4.3. Our IP All software, algorithms, interfaces, and trademarks are owned by FaceSwapAI. You may not copy, reverse engineer, or decompile the Service.

5. User Warranties

You represent and warrant that:

• You own or have authorization to use the content you upload. • Your use of the Service does not violate third-party rights (privacy, publicity, copyright, etc.). • You assume full legal responsibility for content created using the Service.

6. DMCA / Copyright Compliance

We respect intellectual property rights. If you believe your copyrighted work has been used without permission, contact us with a valid DMCA takedown request. We will investigate and remove infringing material as required.

7. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE." FaceSwapAI makes no guarantees regarding:

• Accuracy or realism of AI-generated results. • Error-free or uninterrupted operation. • Fitness for any particular purpose.

AI results may vary depending on input quality and other factors.

8. Limitation of Liability

To the fullest extent permitted by law, FaceSwapAI is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.

9. Third-Party Links

The Service may include links to external websites. FaceSwapAI is not responsible for their content, privacy practices, or security.

10. Changes to Terms

We may modify these Terms at any time. Changes will be indicated by updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
